DMCA and copyright policy
How to report content on the Site that infringes your copyright, and how to contest a removal.
1. What we can and cannot do
Token names, images and descriptions are uploaded by users, published to IPFS and referenced on a public blockchain. We do not control IPFS or the blockchain and cannot delete content from them. What we can do is stop displaying the content on the Site (hide the image, description or the whole token page). This policy describes how to request that.
2. Sending a takedown notice
If you believe content on the Site infringes a copyright you own or are authorised to act for, send a notice to our designated agent at [DMCA contact email] or [postal address]. To be effective under 17 U.S.C. § 512(c)(3) the notice must include:
- Identification of the copyrighted work you claim has been infringed (or a representative list if there are several).
- Identification of the material you want removed, with enough detail for us to find it: the token address or Site URL, and the IPFS link if you have it.
- Your name, mailing address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.
- Your physical or electronic signature.
Incomplete notices may be ignored. Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. § 512(f).
3. What happens next
On receipt of a valid notice we will promptly stop displaying the identified material on the Site, make a reasonable attempt to notify the user who uploaded it (we usually only know a wallet address, so notification may be by on-chain message or a notice on the token page), and record the notice. Removal from the Site does not remove the content from IPFS or the blockchain.
4. Counter-notice
If you uploaded material that was removed and believe the removal was a mistake or misidentification, you may send a counter-notice to the same address containing:
- Identification of the material and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, telephone number and email address, and a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the United States, [the applicable jurisdiction]) and that you will accept service of process from the person who sent the original notice.
- Your physical or electronic signature.
If we receive a valid counter-notice we will forward it to the original complainant. Unless they tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days.
5. Repeat infringers
We may hide all content associated with wallet addresses that are the subject of repeated valid notices.
6. Trademark and other complaints
Complaints about impersonation, trademark misuse or other unlawful content that are not copyright claims can be sent to the same contact with a description of the issue and the token address. We handle them under our Terms of use.
