Terms of use
The rules for using the init.ro0t website.
1. Who we are and what this is
The website at init.ro0t.xyz and its subdomains (the "Site") is operated by [Company legal name] ("we", "us"). The Site is a user interface that lets you view information about, and construct transactions for, a set of open-source smart contracts deployed on the HyperEVM blockchain (the "Protocol"). By using the Site you agree to these terms. If you do not agree, do not use the Site.
2. Non-custodial; we are not a party to your transactions
We never hold your assets or your keys. Every transaction is constructed in your browser and signed by your own wallet. Once you sign, the transaction is executed by the blockchain and the Protocol's contracts, not by us. We cannot reverse, cancel, speed up or refund any transaction, and we cannot recover assets sent to a wrong address. The Protocol's contracts are immutable and have no function that lets us move user funds or liquidity.
The Protocol can be used without the Site, from any blockchain explorer or wallet. The Site is one convenience front-end among possible others.
3. Eligibility
You may use the Site only if you are at least 18 years old (or the age of majority where you live, if higher), are legally permitted to use it under the laws that apply to you, and are not a person or entity that is subject to sanctions or located in a jurisdiction listed in Section 8.
4. No advice, no offer
Nothing on the Site is investment, financial, legal or tax advice, and nothing is an offer or solicitation to buy or sell any token. Tokens launched through the Protocol are created by third parties we do not control, review or endorse. A token's presence on the Site means only that it was created by the Protocol's contracts. Documentation, simulations and figures on the Site describe how the contracts work or what a model produced; they are not forecasts.
5. Risks you accept
- Tokens created through the Protocol can lose all of their value. Most will.
- Smart contracts can contain bugs. The Protocol has not been externally audited as of the date above.
- Blockchains can be congested, forked or halted; transactions can fail or execute at a different price than quoted.
- Third-party services the Site depends on (RPC nodes, indexers, IPFS gateways, HyperSwap) can fail or change.
- Laws applying to digital assets vary and change; use of the Protocol may be restricted or taxed where you live.
You use the Site and the Protocol entirely at your own risk.
6. Prohibited use
You agree not to use the Site to: violate any law or sanction; infringe anyone's intellectual property or other rights; launch tokens that impersonate a person, brand or project, or whose metadata contains unlawful, defamatory or abusive content; manipulate markets, including wash trading and coordinated deception; interfere with the Site's operation, scrape it abusively, or attempt to bypass any access restriction; or upload malware or content you have no right to distribute.
We may remove metadata, hide tokens, or block addresses from the Site for any of the above. Doing so does not and cannot affect the on-chain contracts.
7. Content you upload
Names, symbols, images, descriptions and links you submit when launching a token are published to IPFS and recorded on a public blockchain. They are public, permanent and cannot be removed by us. You are responsible for having the rights to everything you upload and you grant us a non-exclusive, worldwide, royalty-free licence to display it on the Site. Copyright complaints are handled under our DMCA policy.
8. Restricted jurisdictions
The Site is not available to persons located in, incorporated in, or ordinarily resident in [list of restricted jurisdictions, to be confirmed by counsel; at minimum, jurisdictions subject to comprehensive sanctions]. We may use technical measures to restrict access from those places. Using a VPN or other means to evade such restrictions is a breach of these terms.
9. Intellectual property
The Protocol's contract source code is published under the licence stated in the repository. The Site's design, text and branding are owned by us. You may use the Site's documentation for personal, non-commercial purposes with attribution.
10. No warranty
The Site and the Protocol are provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability.
11. Limitation of liability
To the fullest extent permitted by law, we and our affiliates, contributors and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, tokens, data or goodwill, arising out of or related to your use of the Site or the Protocol, even if advised of the possibility. Our total liability for any claim will not exceed the greater of [amount] or the fees you paid to us (not to the Protocol) in the twelve months before the claim. Some jurisdictions do not allow these limits; in that case they apply to the extent permitted.
12. Indemnity
You will indemnify and hold us harmless from claims, damages and costs (including reasonable legal fees) arising from your use of the Site, your content, or your breach of these terms.
13. Changes and termination
We may change these terms by posting a new version with a new date. Continued use after that is acceptance. We may suspend or discontinue the Site at any time. The Protocol's contracts continue to exist regardless.
14. Governing law and disputes
These terms are governed by the laws of [governing jurisdiction], without regard to conflict-of-law rules. Disputes will be resolved [exclusively in the courts of / by binding arbitration in] [venue]. [Class-action waiver, if applicable.]
